Applicable legislation
The purchase and sale of products and services via electronic means is governed by Legislative Decree 6 September 2005 n. 206 (Consumer Code) regarding remote sales with consumers, (i.e. a natural person who purchases the goods for purposes unrelated to any business or professional activity carried out, or does not make the purchase by indicating a reference in the order form VAT number), and by Legislative Decree 9 April 2003 n. 70 on electronic commerce. The sales contract entered into between the Customer and shop.simes-sicurezza.com will be governed and interpreted in accordance with Italian law.
Acceptance of the general conditions of sale
By placing an order according to the various methods provided on the Site, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general conditions of sale and payment indicated on the site. Method of purchase
The Customer can purchase the products visible at the address shop.simes-sicurezza.com, illustrated on the homepage of the Site within the respective sections by product category, as described in the relative information sheets. The products published on the site may be physically available in the warehouse and therefore, as such, can be ordered by the customer. The order cannot be made in relation to products which, although present in the catalog of the site, are without a trolley as available. In this case the product cannot be ordered by the Customer and, if he wishes, he can leave his e-mail address to be notified if the product itself will become available again. In any case, the products on the site are offered until exhaustion of their availability. In order to make purchases, the Customer must be registered on the site. When the purchase is made, the Customer has the possibility to choose the payment methods published in the "Payment methods" section of the product he prefers. Delivery methods and costs
Delivery costs are charged to the customer. For the delivery of the goods, the presence of the Customer or his representative is required at the recipient's address indicated in the order.

Jurisdiction
Without prejudice to the possible applicability of mandatory provisions of the law aimed at protecting consumers (as defined pursuant to article 1 letter b) of Legislative Decree 22 May 1999 n.185), any dispute in any case connected to these General Conditions, will be devolved to the exclusive jurisdiction of the Court of Rome.
Legal Guarantee
Pursuant to Legislative Decree 206/2005 ("Consumer Code") all products on sale on this site are covered by the 24-month legal guarantee.
On the basis of the 24-month legal guarantee, shop.simes-sicurezza.com is liable towards the consumer (the natural person who acts for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out) for non-detectable conformity defects at the time of purchase.
The lack of conformity exists when the product is not suitable for the use for which it must usually serve, does not conform to the description or does not possess the qualities promised by the seller, does not offer the usual qualities and performance of a good of the same type, does not it is suitable for the particular use desired by the consumer if brought to the attention of the seller at the time of purchase and accepted by the seller (art. 129 of the Consumer Code).
The lack of conformity that occurs within 24 months from the date of purchase of the goods must be reported within 2 months from the date of discovery of the defect.
Unless proven otherwise, it is assumed that the lack of conformity which occurs within 6 months of delivery of the goods already existed on that date. In the event of a lack of conformity, the consumer has the right to restore, without charge, the conformity of the goods by repair or replacement (Article 130 of the Consumer Code). The consumer can ask the seller, at his choice, to repair the goods or to replace them, free of charge in both cases, unless the requested remedy is objectively impossible or excessively onerous compared to the other. Repairs or replacements must be carried out within a reasonable period of the Consumer's request; the average delivery time to the consumer is 24 days. If within the maximum period of 60 days shop.simes-safety.

Timing and methods of exercising the Legal Guarantee
All products for sale on this site, in addition to being covered by the Legal Guarantee, are covered by the Manufacturer's Guarantee.
The Manufacturer's Warranty is added to, but does not replace, the 24-month Legal Warranty in any case due by right to the consumer, under the conditions established by law. Duration, territorial extension and methods for asserting this guarantee are indicated in the appropriate form, drawn up by the manufacturer.

These general conditions of sale will remain valid and effective until they are modified and/or integrated by shop.simes-sicurezza.com.
